CHATTANOOGA GO — TERMS OF SERVICE

1. Agreement to Terms

By downloading, accessing, or using the Chattanooga Go mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Chattanooga Go is a product of Chattanooga Local, a brand operated by Marketing Velocity ("Company," "we," "our," or "us"). By using the App you are entering into a legal agreement with Marketing Velocity.

2. Description of Service

Chattanooga Go is a local discovery platform that provides users with information about businesses, events, activities, and points of interest in and around Chattanooga, Tennessee and surrounding areas. The App is provided free of charge to end users.

3. Eligibility

You must be at least 18 years of age to use this App. By using the App you represent and warrant that you are at least 18 years old. Some content within the App references alcohol-serving establishments and is intended for users of legal drinking age (21+) in accordance with applicable laws.

4. Business Listings

4a. Accuracy of Information Chattanooga Go strives to provide accurate and up-to-date information about local businesses. However we make no guarantees regarding the accuracy, completeness, or timeliness of any business listing, including but not limited to hours of operation, pricing, menu items, services offered, or availability.

4b. Third Party Information Business information may be sourced from public records, third party databases, or directly from business owners. We are not responsible for errors or omissions in business information.

4c. Business Owner Responsibility Business owners who claim or manage their listings are solely responsible for the accuracy of the information they provide. Marketing Velocity and Chattanooga Local assume no liability for inaccurate information submitted by business owners.

4d. Right to Remove We reserve the right to remove, modify, or decline any business listing at our sole discretion without notice or explanation.

5. Paid Business Listings

5a. Featured Listings Businesses may purchase featured placement, promoted events, or other paid services through Chattanooga Go. Payment terms, pricing, and refund policies will be provided at the time of purchase.

5b. No Guarantee of Results Paid placement does not guarantee any specific number of views, clicks, calls, or customers. We make no representations about the commercial results of any paid listing or promotion.

5c. Refunds All sales of featured listings and promotional services are final unless otherwise stated in writing at the time of purchase.

5d. Termination of Paid Services We reserve the right to terminate any paid listing or service if the business violates these Terms, provides false information, engages in illegal activity, or for any other reason at our sole discretion. In such cases refunds will be issued on a pro-rata basis at our discretion.

6. User Conduct

By using the App you agree not to:

Use the App for any unlawful purpose

Attempt to gain unauthorized access to any part of the App or its systems

Scrape, copy, or redistribute App content without written permission

Submit false, misleading, or defamatory information

Interfere with the operation of the App or its servers

Use the App to harass, harm, or defraud any person or business

7. Intellectual Property

7a. Our Content All content within the App including but not limited to text, graphics, logos, icons, images, and software is the property of Marketing Velocity or its content suppliers and is protected by applicable intellectual property laws.

7b. The "Only in Chatt" Badge The "Only in Chatt" designation and badge is a proprietary feature of Chattanooga Go. Businesses may not claim, reproduce, or misrepresent this designation outside of the App without written permission from Marketing Velocity.

7c. Your Content If you submit any content to us including business information, photos, or feedback, you grant Marketing Velocity a non-exclusive, royalty-free, perpetual license to use, modify, and display that content in connection with the App and related marketing materials.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MARKETING VELOCITY AND CHATTANOOGA LOCAL DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO:

Accuracy or completeness of business information

Uninterrupted or error-free operation of the App

Fitness for a particular purpose

Results from using the App

We do not warrant that business hours, pricing, availability, or any other information displayed in the App is current or accurate.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARKETING VELOCITY, CHATTANOOGA LOCAL, AND CHATTANOOGA GO SHALL NOT BE LIABLE FOR ANY:

Indirect, incidental, or consequential damages

Loss of profits or revenue

Damages arising from reliance on inaccurate business information

Personal injury or property damage arising from use of the App

Unauthorized access to your device or data

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED $100.

10. Indemnification

You agree to indemnify, defend, and hold harmless Marketing Velocity, Chattanooga Local, Chattanooga Go, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

Your use of the App

Your violation of these Terms

Your violation of any third party rights

Any content you submit to the App

11. Third Party Links and Services

The App may contain links to third party websites or services including business websites, event ticket platforms, and mapping services. We are not responsible for the content, privacy practices, or terms of any third party service. Your use of third party services is at your own risk.

12. Events and Activities

Chattanooga Go provides information about local events and activities for informational purposes only. We are not the organizer of any event listed in the App and assume no responsibility for event cancellations, changes, injuries, or any other issues arising from attendance at any listed event.

13. Alcohol Related Content

Some business listings and content within the App reference alcohol-serving establishments, happy hour specials, and bar listings. Chattanooga Go does not promote underage drinking. Users are responsible for complying with all applicable laws regarding alcohol consumption. Marketing Velocity assumes no liability for any alcohol-related incidents arising from use of the App.

14. Geographic Limitations

Chattanooga Go is designed for use in the Chattanooga, Tennessee metropolitan area and surrounding regions. We make no representation that the App is appropriate or available for use in other locations.

15. Modifications to the App and Terms

15a. App Changes We reserve the right to modify, suspend, or discontinue the App or any feature at any time without notice or liability.

15b. Terms Changes We may update these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the App shall be resolved in the state or federal courts located in Hamilton County, Tennessee.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Marketing Velocity regarding your use of the Chattanooga Go App.
